Former DOJ National Security Counsel Brian Fleming Joins Miller & Chevalier’s International Practice

Washington, D.C. (September 12, 2017) – Miller & Chevalier Chartered today announced that Brian J. Fleming joined the firm as a Member in the International Department. Previously, Fleming served as Counsel to the Assistant Attorney General for National Security at the U.S. Department of Justice (DOJ), where he focused on export controls and economic sanctions, foreign direct investment, and cybersecurity.

“Miller & Chevalier is a very entrepreneurial firm with a distinctive brand when it comes to high-stakes investigations and litigation,” Fleming said. “They know their strengths and are uniquely suited to counsel companies operating and growing their international businesses.”

During his tenure at the DOJ, Fleming helped manage and oversee all export control and sanctions prosecutions and investigations. He also managed the DOJ’s review of all transactions before the Committee on Foreign Investment in the United States, which cut across numerous industries, including energy, aerospace, telecommunications, agriculture, insurance, and real estate, among others.

Fleming also served as the DOJ’s liaison with interagency partners on sensitive international trade and law enforcement issues, including the Department of Commerce’s Bureau of Industry and Security, the Department of State’s Directorate of Defense Trade Controls, and the Department of Treasury’s Office of Foreign Assets Control.

At Miller & Chevalier, Fleming will continue to focus on export controls and economic sanctions, and foreign direct investment, as well as related work in the areas of cybersecurity and white collar defense.

Before working with the Assistant Attorney General, Fleming served as a Trial Attorney in the Counterintelligence and Export Control Section of the DOJ’s National Security Division, where he led investigations of individuals and large U.S.-based and international companies suspected of export control and economic sanctions violations. Fleming also investigated and prosecuted cases related to cyber intrusions, economic espionage, and unauthorized disclosures of classified information, among others.

Earlier in his career, Fleming worked in private practice and represented individuals and companies in government enforcement actions and complex civil disputes. He also clerked for the Hon. John D. Bates of the U.S. District Court for the District of Columbia.

Fleming earned his J.D. from Vanderbilt University and his A.B. from Dartmouth College.
