Homer Moyer, Jr. — Member of Miller & Chevalier

homer moyer -- miller & chevalierHomer E. Moyer, Jr. is one of the country’s leading authorities on the U.S. Foreign Corrupt Practices Act and international anti-corruption law. He has written and spoken on the subject extensively, chaired more than 20 national and international conferences, produced a training video, represented and advised dozens of clients, and served as an SEC-appointed Independent Compliance Consultant.

In the area of export controls and economic sanctions, Mr. Moyer’s experience dates from when he served as General Counsel of the U.S. Department of Commerce during a time of historic foreign policy and national security controls. He has counseled numerous clients on export issues of first impression, co-authored the book Export Controls as Instruments of Foreign Policy, and been called to testify as an expert witness. While in government, he co-authored the Anti-Boycott regulations of the Export Administration Act.

In matters of international trade, Mr. Moyer has advised clients on WTO panel and Appellate Body disputes, represented governments in free trade agreement negotiations, and successfully litigated before bi-national panels and “Extraordinary Challenge” tribunals under the NAFTA and CFTA. Mr. Moyer has been counsel in landmark anti-dumping and countervailing duty cases, in trade and investment disputes before international arbitral bodies, and in federal court proceedings involving issues of international law. In other cases, he has represented clients before all levels of federal courts, including the U.S. Supreme Court.

Mr. Moyer has appeared on numerous listings of the country’s leading lawyers, including Chambers (FCPA and Trade Remedies/Trade Policy), Who’s Who Legal (Trade & Customs), Guide to the World’s Best International Trade Lawyers, and Lawdragon’s list of the 500 Leading Lawyers in America.

A political appointee in both Democratic and Republican administrations, Mr. Moyer served as General Counsel (1980-81), Counselor to the Secretary (1979), and Deputy General Counsel (1976-78) of the U.S. Department of Commerce. Before government, he practiced with Covington & Burling; wrote Justice and the Military, a treatise on military law; and served in the Office of the Judge Advocate General of the Navy, with collateral duty at the White House.

Mr. Moyer was the co-founder and Chair (1990-2002) of the American Bar Association’s Central European and Eurasian Law Initiative (“CEELI”), which has provided technical legal assistance to emerging democracies of the former Soviet bloc, a project described by former Attorney General Janet Reno as “the worthiest pro bono project that American lawyers have ever undertaken.” He began the CEELI Institute, a post-graduate lawyer and judicial training institution in Prague, is president of Friends of the CEELI Institute, and has served on the board of the ABA’s Rule of Law Initiative since its inception.

In 2008, the American Bar Association’s International Law Section honored Mr. Moyer with a Lifetime Achievement Award, and Justice Sandra Day O’Connor described him as his generation’s “pioneer in rule of law reform and its greatest proponent.” He has received the ABA’s World Order Under Law Award (1998), the CEELI Volunteer Award (2002), and a special ABA award at Runnymede during the rededication of the ABA Memorial to Magna Carta (2000). He has served as Chair of the ABA’s Section of International Law and Practice (1990-91), a member of its Council (1985-91), and Chair of its International Trade Committee (1984-86).

Mr. Moyer is a member of the Council on Foreign Relations, has been a member of the Boards of Trustees of the Center for American and International Law and the Council for Excellence in Government, and is a past President of the Washington Council of Lawyers. He is a graduate of Emory University, on whose Board of Visitors he has served, and Yale Law School. The father of four, Mr. Moyer is also the author of the best-selling book, The R.A.T. (Real-World Aptitude Test): Preparing Yourself for Leaving Home (Capital Books; 2001).
